
Immigration and Customs Enforcement arrested a Guatemalan illegal alien and alleged child rapist Friday after Fairfax County authorities ignored federal detainers and released him back into Virginia communities, officials announced Tuesday.
Sanctuary Policies Override Federal Request
Garcia entered the United States illegally through Texas in 2023 and received parole into the interior under Biden administration policies. When initially arrested on child rape charges, ICE lodged a detainer requesting Fairfax County notify federal officials before any release. County authorities refused to cooperate and released Garcia directly from custody despite the pending immigration violations. He received a final removal order in February 2026 but remained at large until ICE agents apprehended him last week.
Pattern of Non-Cooperation Endangers Communities
Acting Assistant Secretary Lauren Bis condemned Governor Spanberger and local officials for prioritizing sanctuary policies over public safety. The Department of Homeland Security cited four separate cases where Fairfax County released illegal aliens charged with murder or felony child sex crimes after refusing federal cooperation. Data from April showed three-quarters of murder suspects in the county in 2026 were illegal immigrants. Both Sheriff Stacey Kincaid and Commonwealth’s Attorney Steve Descano face mounting criticism for plea deals that critics label insane and their systematic refusal to work with ICE.
Congressional Hearing Delayed
The House Judiciary Subcommittee on Immigration Integrity, Security, and Enforcement summoned Kincaid and Descano to testify at a hearing titled Fairfax County, Virginia: The Dangerous Consequences of Sanctuary Policies. Originally scheduled for April 15, the hearing was postponed to May 14, 2026. Neither the Fairfax County Sheriff’s Office nor the Commonwealth’s Attorney’s Office responded to requests for comment on their policies that allowed a suspected child predator to remain in American neighborhoods despite federal warnings.
